Net Revenue = all monies received by Ourplays from Customers in relation to casino activities less (a) monies paid out to Customers as winnings, (b) bonuses and/or loyalty bonuses, (c) administration fees, (d) fraud costs, (e) charge-backs, (f) returned stakes (g) monies paid out as duties or taxes (h) jackpot contribution and (i) any commissions/fees due to third parties for providing/licensing games and/or games software

Affiliates should be aware of the following term:

“4.8 Payment of commissions shall be made by the payment method chosen by the Affiliate in the application process, subject to clause 1.5(b). The minimum payout amount is 100 Euro. If the commission is lower than the minimum payout amount, the commission will be transferred to the following month. Excess commission amounts received by the Affiliate shall upon request be immediately repaid together with annual interest at a rate which by 6 percentage units exceeds the reference rate 3 month Euribor. The Company shall have a right to deduct any possible excess payments in previous months from outstanding payment obligations.”

The above terms means that if Shadow Affiliates overpay you and you don’t notice, they can then subsequently treat the affiliate like a bank, gaining interest on the over-payment until the point where you return the additional funds. This potentially creates incentive to make ‘payment errors’.

Conclusion

Shadow Affiliates have made a good start – they’re working on a very reputable platform and for the most part offer attractive affiliate terms and conditions. The one concern we do have is the term requiring affiliates to pay interest on any over-payments made by the program. The rate of interest set is equivalent to a good high interest bank account and creates the incentive for the program to overpay. We’ve no evidence that this is happening, but the term creates the possibility. As such we don’t feel comfortable giving this program higher than Needs Work status.
