Minimum Activity Quota – Yes, see below:

“* At any time where 3 calendar months have passed without the Affiliate directing any Customers to the Operator’s Sites, the default Revenue Reward set out in the table above and any other Revenue Reward agreed by the parties in writing at any time shall no longer apply and instead shall be set at 5% of all Online Gaming Products and Sportsbook.”

We consider any minimum revenue level that is below 15% to by unsustainable for an affiliate and as such an effective Minimum Activity Quota.

“that there is no activity in the Affiliate’s account for forty five days, in which case this Agreement will be deemed to have been terminated by the Affiliate without notice.”

How long does player revenue last? – Revenue for referred players is paid for the lifetime of the player’s activity.

Affiliates should be aware of the following term:

“Notwithstanding deemed termination pursuant to clause 7.1.3.7, any account unused for withdrawals, or otherwise inactive, for a period of at least thirty six (36) consecutive months will be an “Inactive Account”. The Operator shall notify the Affiliate that its account is an Inactive Account and that the Inactive Account Fee will be deducted if the Affiliate does not reactivate its account (“Inactive Account Notice”). The Operator shall be entitled to retain fifty (50) percent of the total balance remaining on the Inactive Account (“Inactive Account Fee”) after 14 days have elapsed from the date of the Inactive Account Notice. Should the Affiliate subsequently fail to withdraw the remaining balance from the account, the Operator shall be entitled to retain the remainder of the balance on the account without further notice to the Affiliate upon expiry of 45 days from the date of the Inactive Account Notice.”

Affiliate Issues – We are aware of one significant affiliate issue against Affiliates United.

This was brought to light on GPWA. The affiliate in question had a significant payment from Affiliates United denied due to the determination of the operator that the player who had generated the commission was involved in arbitrage play and as such the operator refused to pay any commission for the customer using fraud related terms.

There are several issues with the above. Firstly arbitrage play cannot in any legal sense be considered fraud. It is simply intelligent selection of bets across different bookmakers so that the player comes out ahead. Operators may not like this, but it’s not fraud.

Putting that aside, the basic reason that operators will not pay out on fraud traffic is that they lose money on it. Where a player issues a charge back on their losses for example – the casino cannot pay the affiliate for the earnings that have been charged back. Likewise, where a network of players are found to be colluding (or operated by a single individual/small group) while the players registered to that affiliate may have lost money, generating the affiliate revenue, other players within the group are likely to have won more than the collective group has lost. As the group is a non-profitable entity for the operator, paying affiliate revenue for this type of activity is only making the situation worse for the operator.

There are good reasons that operators will not pay for these types of traffic.

In this situation however, the player in question is placing bets and either winning or losing. The player lost a significant sum to the operator and almost certainly will not have had their losses returned when the operator decided to restrict their activity. That means the operator came out substantially ahead due to this player’s activity and it is only the affiliate that loses out.

This may be technically covered within the terms and conditions at Affiliates United, it would likely require a legal challenge to establish this with complete certainty, but utilising fraud related terms to deny payment on profits earned in this manner certainly doesn’t sit well as the use actually intended for those terms.

Affiliates should be aware of the following term:

“The Operator does not support any kind of content stealing or copying (site scraping) or any breach of any intellectual property rights, and it reserves the right to suspend and if necessary terminate the Affiliate’s account with it, if it is proven that the Affiliate is responsible for using such methods, and/or to transfer the amounts payable to the Affiliate to the original content creator and/or intellectual property rights holder.”

Conclusion

Given the size of the William Hill operation the number of complaints that have not received a response is proportionally small. This lack of transparency is enough that we’re not willing to work with William Hill, but we would not criticise other affiliates overly for doing so.

What should worry affiliates is a host of terms that are demonstrably negative. A summery is included below:

• Negative Carryover policies – if your players have a win large enough to create a significant negative balance for you, this creates a situation where you no longer have any incentive to carry on marketing the program’s brands. This leads to a short-term mind set to working relationship between the affiliate and the program.

• Reducing revenue share to 5% if you fail to send a player in a 3 month period. This creates a situation where the affiliate is to all intents and purposes handcuffed to the operator if they want to receive their due revenue for historic traffic.

• The right to terminate your account if there’s no activity on it for 45 days.

• Right to seize the full account balance after 36 months and 45 days if you have not logged in.

Right from the outset a Minimum Activity Quota which is what the reduction to 5% revenue amounts to, should be unacceptable to all affiliates as it does not allow for any sort of flexibility in a rapidly changing market, but there are many other good reasons not to work with Affiliates United including their lack of willingness to discuss player complaints, their market saturation or their weak revenue ladder even when the Minimum Activity Quota is discounted.
