“(a) if the form of Commission that you receive from us is Revenue Share Commission., you will generate a minimum of one (1) Qualified Player for each of Our Site(s) which you market pursuant to these Terms for each consecutive period of ninety (90) days commencing on the date upon which we confirmed our acceptance of your Application Form to join the PokerStars Partners Program;”

“4.3.2 will (in the case of Revenue Share Commission) cease to be payable in respect of each Qualified PS Player on that date which is twenty-four (24) months after the date on which that internet user first opened a User Account as part of the process of becoming a Qualified PS Player. “

“4.5 Professional Players. In the event that any one (1) or more Qualified Players are selected to become a member of the “Team PokerStars: Pro”, “Team PokerStars: Online” or “Full Tilt Poker Professionals”, you acknowledge and agree that with effect from the first day of the calendar month falling immediately after the date of such selection, the relevant Qualified Player(s) shall cease to be tracked by us as having been referred by you and you will no longer be entitled to receive any Commission in respect of such Qualified Player.”

Player Issues – We are not aware of any player issues with the Pokerstars Partners properties.

Affiliate Issues – Historically this group experienced difficulties with the US Department of Justice due to their acceptance of US traffic. This resulted in company funds being frozen for a significant period of time. Subsequently our understanding is that player were paid. However, the statement on the Pokerstars Partners site regarding affiliate payments is as follows:

“The Rational Group, which operates PokerStars, obtained certain assets of Full Tilt Poker as part of a settlement reached with the US Department of Justice Southern District of New York. This settlement excluded liabilities, including previous contractual agreements with affiliates that may have provided rewards in the past.”

In other words, the company that now controls these sites has arranged a deal where they’ve taken the players referred by affiliates, but the “liabilities” that were due in compensation for these referrals have been left unhonoured by this takeover deal.

While this arrangement may be legally viable – we could not offer opinion on this – given that the current owners of this group benefit from the work and expenditure of the affiliates that build the business and player base of these operators, to specifically negotiate an arrangement where they could leave these historic affiliates unpaid sits as an extremely uncomfortable action to take.

Affiliates should seriously consider these actions when deciding whether or not this program is a partner they can trust.

Conclusion

There are a large number of issues that affiliates should be aware of when considering whether or not to work with Pokerstars Partners. Firstly we have the history of a group of operators where the current owners negotiated a deal to take over the business that specifically left behind the debts that were incurred to the affiliate partners that helped build and establish the business. So they’re profiting from the hard work of these affiliates but have explicitly left them unpaid. Then we’ve got a revenue ladder that is low enough on the bottom end that we would consider it to effectively be a Minimum Activity Quota, cutting off your ability to end on referred players after two years and a lack of definition of whether negative balances are carried over. We simply cannot objectively view this program as affiliate friendly.
