Revenue Calculation Formula
Net Revenue = the total wagers of a Customer minus (i) winnings, (ii) bonuses, (iii) chargebacks, (iv) third party licensing fees, (v) jackpot insurance contributions, (vi) duties and taxes, and (vii) any other cost incurred by the Company and the Operator due to a fraudulent and/or abusive activity of the Customer.

Affiliates should be aware of the following term:
“5.15. CPA will only be paid on qualifying players from the following countries: Canada, South Africa, Ireland, UK, New Zealand, Isle of Man, Jersey, Malta, Norway, Finland, Sweden, Netherlands, Germany, Austria, Switzerland, Liechtenstein, Luxembourg, Monaco and Quebec unless agreed otherwise in writing by Us.”
Negative Carry Over – Yes, see below:
“3.2. No-Negative Carryover Policy: In case your Account Balance under a Revenue Share Payment Plan in any given month is negative due to Customer winnings and/or Non Cash Items and/or Cash Items and/or Progressive Contributions said balance will be set to zero at the start of the next monthly period. A negative balance due to Fraud may be carried over. Negative Player balances will continue to be tracked independently of the No-Negative Carryover Policy.
3.3. Negative Player Balances: Individual Net Revenue balances shall be tracked for the lifetime of the Player and will not contribute further positive commission payments unless the lifetime balance of the given Player is in positive Net Revenue.”
We consider the above term to be easily mis-interpreted. While your collective negative balance at the end of the month will not be carried forward and offset against the following month’s revenue, your individual players’ balances are carried forward and you are not allowed to earn on an individual player unless all negative balances have been repaid. While this is not quite full Negative Carry Over – it allows the negative balances of any winning player who stops playing to expired – it is far closer in effect to full Negative Carry Over than it is to No Negative Carry Over. Advertising this policy as “No-Negative Carryover” is in our opinion a questionable representation of the policies as they function.

Player Issues – Both Progress Play and Nektan carry dormancy and progressive jackpot withdrawal terms that we consider to be predatory in nature.
Affiliate Issues – We are not aware of any unresolved affiliate issues with Onyx Affiliates.
Where players are concerned, we have issues with the way the platform providers that the Onyx Affiliates casinos operate on are managing certain policies. We won’t currently work with these platforms. However, we wouldn’t frown on other affiliates choosing to do so.
As for affiliates, the terms and conditions offered by Onyx Affiliates are broadly reasonable when you exclude advertising themselves as No Negative Carry Over but including small print that would seem to make them effectively largely Negative Carry Over. It just seems a bit of a mis-representation about the policies that they are actually enforcing. We would certainly view them as having NCO.
