7.1.3 Notwithstanding the provisions of clause 7.1.1 above, the Company may immediately terminate this Agreement if it determines, at its sole discretion:

7.1.3.10 that there is no activity in the Affiliate’s account for continuous forty five day period, in which case this Agreement will be deemed to have been terminated by the Affiliate without notice. For the purposes of this clause 7.1.3.9 the term “no activity” shall mean no new depositing Customers introduced by the Affiliate.
