A summary of the issues:

• Negative Carryover policies – if your players have a win large enough to create a significant negative balance for you, this creates a situation where you no longer have any incentive to carry on marketing the program’s brands. This leads to a short-term mind set to working relationship between the affiliate and the program. This is a hybrid term, wiping the first $500 of any negative balance, but the problems with negative carry over occur when there’s a substantial negative balance not when there’s a little one.

• Detagging any player who does not play for 180 or reducing commission on those players to unspecified amounts.

• Closing your account if you have 365 days without sending a player and non-payment of commission if you don’t respond with 180 days of closure of your account.

• Closing your account if you fail to log request a payment every 180 days and non-payment of commission if you don’t respond with 180 days of closure of your account.

• A term allowing 440Affiliates to continue accepting traffic through your link without paying you for it if your account is closed.

All in all – in our opinion – the above terms paint a picture of a program that’s looking for any reason it can find to justify closing your account and not paying for the traffic you’ve sent. The closure terms likely wouldn’t be enforced if you’ve generated minimum traffic for the program, but that doesn’t diminish the threat these terms represent to affiliates.

We would also highlight that this program actively promotes itself with the following statement:

“Our main policy is NOT to accumulate negative balance to any of our affiliates”

This is then quantified within the small print as only applying to the first $500 of any negative balance. Many programs operate a No Negative Carryover policy. In our opinion this statement skates dangerously close to mis-representation of the policy being applied.
