“15.1 Unless otherwise agreed to by 10bet in writing, in the event that the total Net Revenue from your referred New Customers is negative for a given calendar month, the negative balance will be carried over from month to month, until a positive balance is achieved (i.e., until such time as the negative balance has been fully set-off against future positive amounts generated by your New Customer referral activity) (“Negative Carry Over Policy”).

15.2 In the event that you are not eligible for an Affiliate Commissions payment or you are Inactive Affiliate, and you carry over a positive total Net Revenue amount for a given month, any negative total Net Revenue from the following calendar month shall be offset against the positive total Net Revenue carried over from the previous month.

15.3 In the event that you are paid Commissions based on Net Revenue and we agree in writing that Sections 15.1 and 15.2 will not apply to you the following shall apply: in the event that the total Net Revenue generated by any High Roller is negative for a given calendar month, the negative balance will be carried over from month to month, until a positive balance is achieved (i.e., until such time as the negative balance has been fully set-off against future positive amounts generated by such High Roller) (“High Roller Policy”). 10bet may at any time notify you that the High Roller Policy shall no longer apply and in such instance the Negative Carry Over Policy and Sections 15.1 and 15.2 shall automatically apply which includes without limitation to any negative balance of a High Roller at such time.”

“Inactive Affiliate: An Affiliate who has: (i) not logged into its account with the 10bet Affiliate Programme Portal for ninety (90) consecutive days; or (ii) not generated a minimum of five (5) New Customers in any three (3) consecutive calendar months”

“11.1 In the event that you fail to refer any New Customer during any consecutive 3 month period, we reserve the right to reduce your Commission rate to a flat rate of no more than 10% of Net Revenue until you introduce a total of 3 New Customers within a 3 month period, at which point (effective upon your referral of the third New Customer) your Commission rate will revert to the standard Commission rates set out above.”

“14.1 Your 10bet Affiliate account must have a minimum of five (5) New Customers in the prior three calendar months before you may be eligible for any affiliate payment. If you became an affiliate after May 1st, 2021 this Section shall not apply to you.”

Conclusion

The 10bet affiliate terms are chock full of terms that are not affiliate friendly. From an exceptionally uncompetitive revenue ladder that is clearly targeted at only bigger affiliates, or smaller affiliates that are going to promote them close to exclusively, to Negative Carry Over and a list of Minimum Activity Quota terms, they simply don’t make for an attractive package comparative to other programs that affiliates can partner with. In fairness, the 10bet team have expressed to us that many of the terms are open to negotiation and that they intend to offer a bespoke deal for each affiliate. The reality of this is that you will have to engage a commercial negotiation prior to working with this program and if you want to make significant positive changes to the contract you are likely to need a substantial amount of leverage.
